Terms of Service

These Terms of Service ("Terms") govern your access to and use of OpenCAD, operated by CariHQ Ltd ("we", "us", or "our"). By creating an account or using OpenCAD, you agree to these Terms. If you do not agree, do not use the service.
1. Eligibility
You must be at least 16 years old to use OpenCAD. By using the service, you represent that you meet this requirement and that all information you provide is accurate.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@opencad.archi if you suspect unauthorised access.
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Free Trial
New accounts receive a 14-day free trial with access to all features. No credit card is required to start a trial. At the end of the trial period, access to paid features may be restricted until a subscription is activated. We will notify you before your trial expires.
4. Acceptable Use
You agree not to:
- Use OpenCAD for any unlawful purpose or in violation of any applicable regulations.
- Upload malicious code, malware, or any content designed to harm the service or other users.
- Attempt to gain unauthorised access to any part of the service or its infrastructure.
- Reverse engineer, decompile, or extract source code from the service beyond what is permitted by the open-source licence.
- Resell or sublicence access to OpenCAD without our written consent.
- Use the service in a way that could damage, disable, or impair it.
5. Your Content
You retain full ownership of all project data, models, drawings, and files you create or upload ("Your Content"). By using OpenCAD, you grant us a limited licence to store, process, and transmit Your Content solely to provide the service to you.
We do not claim ownership of Your Content, and we do not use it to train AI models or share it with third parties except as described in our Privacy Policy.
6. Open Source
The OpenCAD client application is open source and available under the terms of its licence on GitHub. These Terms apply specifically to the hosted service at opencad.archi. The open-source code is made available for contributions and review; OpenCAD is provided exclusively as a hosted service by CariHQ Ltd.
7. Intellectual Property
The OpenCAD name, logo, and the design of the hosted service are the property of CariHQ Ltd. The open-source components of OpenCAD are licensed as described in the repository. Nothing in these Terms transfers any intellectual property rights to you beyond what is expressly stated.
8. Availability and Changes
We aim to keep OpenCAD available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time. Where practicable, we will give advance notice of significant changes.
9. Disclaimer of Warranties
OpenCAD is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Use of the service is at your own risk.
10. Limitation of Liability
To the fullest extent permitted by law, CariHQ Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, arising out of or in connection with your use of OpenCAD, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim, or £100, whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless CariHQ Ltd and its officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of OpenCAD, Your Content, or your violation of these Terms.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by a notice on the service. Continued use of OpenCAD after changes take effect constitutes acceptance of the updated Terms.
